Rental Terms & Conditions

Rental

Customer agrees to rent a Wishing Well for an event (the  "Rental Time"). The Rental Time shall include one day prior to the event (for delivery or pick up by customer), the event date, and one day after the event (for collection or drop off by customer), unless otherwise arranged.

Payments

Customer agrees to pay all costs and fees associating with rental of a Well.

The full fee, which is the rental fee plus the delivery fee, is due at the execution of the rental agreement. For customers who pick up and drop off the Wishing Well, an additional security deposit of $100 will be charged, which will be refunded upon return of the Wishing Well in pristine condition.

All payments are to be made in US dollars.

Payments can be made by cash or check.

Cancellation

If Customer cancels more than three (3) weeks before the Rental Time, Customer will receive a full refund.

An administration fee of thirty dollars ($30.00) shall be charged for cancellations within three (3) weeks of the Rental Time. 

Intention

Customer cannot modify, change or reconstruct the Well in any way.

Customer cannot lend the Well to a third party without express written consent.

Maintenance, Damage, Destruction and Theft

Customer will use, maintain and take care of the Well in a careful and responsible manner.

In the event that Customer returns the Well in a bad and/or poorly maintained condition, and requiring special attention, Customer will forfeit the security deposit.

Customers who fail to return a Well due to destruction, theft, or any other reason, will be charged an additional one hundred dollars ($100.00), payable immediately after failure to collect (or failure to drop off) the well at the scheduled time. Refusal to pay the additional monies shall incur immediate legal action.

Liability

Customer is the sole custodian of the Well during the Rental Time, and as such, undertakes to exercise effective and exclusive control of the Well.

Wells by Raquel assumes no liability during the Rental Time, in particular regarding any cards, envelopes, gifts  and/or monetary donations that may be stolen or removed from the Well during the Rental Time.  It is the responsibility of the Customer to make sure the Well is empty of any and all items before being returned to Wells by Raquel.

Venue OF LAW

A rental agreement shall be governed by the laws of the State of New Jersey without regard to conflict.  All claims or disputes shall be adjudicated in the the Superior Court of New Jersey, in the City of Elizabeth, in the County of Union.

Terms and Conditions listed above are subject to change without notice, and are not binding upon either Wells by Raquel or Customer. Only a Rental Agreement is binding upon execution.
